Welcome to the home page of the L. Craig Kendrick, et al. v. Ohio Casualty Insurance Company, et al., website.
The purpose of this website is to inform individuals and corporations in the State of Kentucky who purchased insurance from Ohio Casualty Insurance Company, West American Insurance Company, and Indiana Insurance Company, between June 9, 2001 and December 31, 2010, and from Liberty Mutual Fire Insurance Company between March 11, 2003, through December 31, 2010 and who paid local government taxes on their payments of premiums which were either not owed, or at rates higher than permitted, that you could be entitled to benefits under a class action settlement.
The lawsuit claims that some of Defendants’ Kentucky policyholders paid local government premium taxes (“LGPT”) and collection fees in connection with their insurance policy premiums that either were not owed or were charged at rates higher than legally required. The lawsuit seeks refunds of these amounts during certain time periods. Defendants deny they did anything wrong.
Local government premium taxes are taxes charged by Kentucky local governments that are calculated and collected by Defendants and then paid to Kentucky local governments. Collection fees are fees calculated and collected by Defendants as compensation for collecting local government premium taxes.
